    Hi there,

is there any way to save the users consent to Terms of Service and Privacy Policy to the usermeta in the database when the register?

I would like to have evidence of it in the database with a timestamp.

    Thanks,
    Stepha

IF you have setup Terms & Conditions, per the instructions from the get-go, the information is already there. Because SWPM members cannot register, without agreeing to the Terms & Conditions (T&C), the material fact that they have SWPM memberships constitutes “De Facto Agreement with the T&C,” in an American court of law. The date of registration is inmaterial, because agreement with the T&C is required to register; irregardless of when they registered.

    Thanks for your reply.
Your are probably right, that any court would accept it as it is set up.
For the time being, I just keep it as it is.

    Best,
    Stephan

    Hi The Assurer,

In Europe we need to comply with GDPR law, and what you say (and what the plugin does), it’s not enough, I’m afraid.

    Please have a look:

    https://ico.org.uk/for-organisations/guide-to-data-protection/guide-to-the-general-data-protection-regulation-gdpr/lawful-basis-for-processing/consent/

    https://ico.org.uk/for-organisations/guide-to-data-protection/guide-to-the-general-data-protection-regulation-gdpr/consent/how-should-we-obtain-record-and-manage-consent/

Therefore, other plugins, like Paid Membership Pro, save consent.

This should be a very easy thing to implement in any form and it’s crucial and urgent that you update your plugin in this regard: The registration form needs to save the positive tick, which means the user gives consent. This needs to be saved with a timestamp and should be saved, for instance, like the username, in a field that is not modifiable by the webiste admin.

Please, let developer know…. Tomorrow I’m planning to go from staging to live. I live in Europe and I need to save consent like this!

Please make this plugin totally GDPR compliant before any of us users go into trouble for not being saving our users’ consent. 🙂

Many thanks in advance. This plugin is, otherwise, great!

@Marta — We are confused. You cited information on a UK website. Isn’t the UK leaving the EU next month?

I live in Spain. I just cited from a source in English for everyone here to understand, no matter if UK is part of Europe or not.

BUT, if you think that being outside Europe you don’t need to comply with GDPR, that’s wrong.

This forum, for instance. Where is it hosted? Is it outside Europe? But you have users, like me and others, who are living in Europe.

Just because your system is storing data from European users you need to comply with GDPR. Adn just because you store my data if I buy a premium addon from you, you need to comply with GDPR.

I do know that being GDRP compliance is very painful. I can tell. But unless you don’t store European users in your systems, you need to comply. Otherwise, you can be hardly penalized.

That’s why so many services have updated themselves to become compliant. Because penalties are huge, and can ruin any business forever.

And that’s why so many other services, whose owners focus on, let’s say, american users, but however, European users come to their sites and sign up, and whose sites are not complying with GDPR, and they might get reported and penalized for this.

So, it’s irrelevant if UK is or not part of Europe…

GDPR is for everybody, and needs to be taken very seriously.

    Please see these links:

    https://www.forbes.com/sites/forbestechcouncil/2017/12/04/yes-the-gdpr-will-affect-your-u-s-based-business/#5bb2e5dd6ff2

And please make Simple Membership fully compliant for the safety of all us, your users, both in Europe and outside Europe.

As I said, and although I’m not a developer, this is apparently quite easy. I did it myself with my contact form. We need evidence that the user ticked the acceptance box, and a record of it with a timestamp and an IP to prove it. With Paid Membership Pro, this was something you could see on the edit user screen. Only that, of course, it was not an editable field.

I really hope that this post help us all to become GDPR compliant.

    Kind regards,
    Marta

Como puedo cumplir con la GDPR con este plugin?
Tengo SM integrado con MailchimP. Cuando los suscriptores me llegan a través de SM no recibo un email con los datos para cumplir GDPR (email, marca de tiempo, una IP ).

I need to comply with GDPR law. I have the Mailchimp add-on. I have seen that I can opt-in is handled by MailChimp, instead of the plugin. This option doesn´t make sense for my because it involve a few confirmations emails:

    1. Client buy in the web.
    2. Receive email membership registration
    3. Receive email activation.
    4. Receive email to confirm subscription(from Mailchimp).

This process involve that the client can buy (the client accepts the privacy policy) and does not confirm the subscription. is there any way to save the users consent to Terms of Service and Privacy Policy to the usermeta in the database when the register?

I would like to have evidence of it in the database with a timestamp to comply with GDPR law.

To save data with the user profile, custom fields are needed. This is something that can be handled by using the following form builder add-on (which allows configuration of custom fields for user profile):

    https://simple-membership-plugin.com/simple-membership-form-builder-addon/

So that can be used to create checkboxes, and the value of those will be held in the database. All of them will just be checked since it is a required field and the user can’t really register without checking it.
